GOVIHUB TERMS OF USE

1. Acceptance of these Terms

By creating an account or using GoviHub, you agree to these Terms of Use. If you do not agree, do not use the platform. Your electronic acceptance is valid and binding under the Electronic Transactions Act No. 19 of 2006 of Sri Lanka.

2. What GoviHub Is

GoviHub is an online introduction and information service for the agricultural sector of Sri Lanka. It helps farmers, buyers, and suppliers find each other by matching harvest listings with demand postings, and it provides agricultural information tools.

3. What GoviHub Is Not

GoviHub is not a buyer, seller, agent, broker, auctioneer, payment processor, or guarantor of any transaction. GoviHub does not own, inspect, store, or transport any produce.

4. Transactions Are Between Users

Any agreement for the sale of produce or goods is formed directly and only between the farmer and the buyer, or between the supplier and the customer. GoviHub is not a party to any such agreement. Price, quality, quantity, delivery, and payment are agreed and performed by the users themselves.

5. Who Can Use GoviHub

GoviHub is intended for farmers, buyers, and suppliers operating in, or sourcing from, Sri Lanka. You must be at least 16 years old to create an account.

6. Your Responsibilities

You must provide accurate information in your profile and listings. You must check the identity, the goods, and the payment ability of the other party before you transact. You are responsible for complying with all laws that apply to your trade, including tax and licensing rules.

7. Your Content

You keep ownership of the harvest listings, demand postings, photographs, and other content you submit. By submitting content, you give GoviHub permission to store, display, and process that content as needed to operate the platform and show your listings to other users. This permission ends when you remove the content or your account, except where we must keep a record to comply with the law.

You must not post misleading quantities, fraudulent listings, or any content that breaks the law of Sri Lanka.

8. Prohibited Uses

You must not:

(a) scrape, reverse-engineer, or automatically crawl the platform beyond what our robots.txt permits; (b) impersonate another person, farm, cooperative, or business; (c) use the platform to target, harass, or threaten other users.

9. AI Features Are Guidance Only

Crop diagnosis, advisory answers, weather information, and match suggestions are generated by software, including artificial intelligence for crop diagnosis and advisory answers. They are general guidance only. They are not professional agricultural, financial, or legal advice. Verify important decisions with a qualified officer or advisor.

10. Limitation of Liability

To the fullest extent permitted by the law of Sri Lanka, including the Unfair Contract Terms Act No. 26 of 1997, GoviHub, its operator AiGNITE Consulting, and their officers, employees, and partners are not liable for any loss or damage arising from: (a) any transaction or attempted transaction between users, including non-payment, non-delivery, short delivery, or quality disputes; (b) the conduct of any user; (c) reliance on AI-generated guidance; (d) interruption or unavailability of the platform.

11. What We Do Not Exclude

Nothing in these Terms excludes or limits liability for fraud, for death or personal injury caused by our own negligence, or for any other liability which cannot be excluded under the law of Sri Lanka.

12. Disputes Between Users

Users must resolve disputes about their transactions between themselves. GoviHub has no obligation to mediate or resolve such disputes. GoviHub may choose to help with communication, without accepting any liability.

13. Suspension and Termination

GoviHub may suspend or remove accounts or listings which break these Terms, contain false information, or harm other users or the platform. You may close your account at any time by contacting support@govihublk.com.

14. Governing Law and Jurisdiction

These Terms are governed by the law of the Democratic Socialist Republic of Sri Lanka. The courts of Sri Lanka have exclusive jurisdiction over any dispute concerning these Terms or the platform.

15. Language

These Terms are published in English, Sinhala, and Tamil. If there is any difference in meaning between the versions, the English version prevails.

16. Changes to these Terms

GoviHub may update these Terms. We will show the updated version on the platform and ask for fresh acceptance when a change is material. Continued use after a change means acceptance.
